    Representatives from the Supreme Court get insight in human rights protection

    On invitation of the judge Ineta Ziemele from the European Court of Human Rights (ECHR), the senator Pēteris Dzalbe from the Department of the Criminal Cases of the Supreme Court Senate, the judge Pēteris Opicāns from the Chamber of Criminal Cases, the Administration manager Anita Kehre, the consultant Biruta Puķe from the Division of Complains, and the assistant Gatis Bārdiņš to the senator of the Department of Administrative Cases of the Senate met in Strasbourg with judges and staff of ECHR and representatives from Latvia working in the Council of Europe.

    Lietu par nodokļu parāda piedziņu nodod jaunai izskatīšanai

    Senāta Administratīvo lietu departaments šodien atcēla Administratīvās apgabaltiesas 2007. gada 12. marta spriedumu daļā, ar kuru ir atcelts Valsts ieņēmuma dienesta (VID) ģenerāldirektora 2004. gada 9. februāra lēmums par Ivara Silacērpa nodokļu parāda Ls 5280,75 bezstrīda piedziņu un šajā daļā lieta nosūtīta jaunai izskatīšanai Administratīvajai apgabaltiesai. Pārējā daļā spriedums atstāts negrozīts. Spriedums nav pārsūdzams.

    Work group for evaluation of possible judges’ ethics violations will be presided by the senator Namatēvs

    The senator Roberts Guntis Namatēvs was elected the chairman of the work group for evaluation of possible ethics violations of judges’ activities. In the first meeting of the work group which took place today, the further plan of actions was coordinated. The work group works out application for the General Prosecutor’s Office requesting it to provide information which is at its disposal regarding the allegedly tapped phone calls of the judges and attorneys. After examination of the information provided by the prosecutor’s office, and the information published in the book “Tiesāšanās kā ķēķis” (“Litigation as cuisine”) by journalist Lato Lapsa, the work group will invite the Supreme Court judges mentioned in the materials to give information and explanation of motives for their actions. The meetings of the work group will be closed. The interim report for the Supreme Court Plenary Session has to be prepared by the work group till December 1.

    Augstākās tiesas Krimināllietu tiesu palāta 18. septembrī, apsūdzētās Rainas Čačas aizstāves advokātes Grīnbergas slimības dēļ, izsludināja pārtraukumu krimināllietas izskatīšanā, kurā par krāpšanu lielos apmēros apsūdzēti Dmitrijs Fjodorovs, Aleksejs Anufrijevs, Arvīds Pupainis, Nikolajs Jurčenko, Raina Čača, Juris Bakāns, Aldis Iekļavs, Ēriks Aņisimovičs un Viktors Gornaks.

    Valerijans Jonikāns is elected the Chairman of the Department of Civil Cases

    On September 17, in the Plenary Session of the Supreme Court, the former Chairman of the Department of Administrative Cases Valerijans Jonikāns was elected the Chairman of the Department of Civil Cases. The Chief Justice of the Supreme Court Andris Guļāns inviting the Plenary Session to vote for V. Jonikāns, informed that the nomination was approved in the meeting of the management of the Supreme Court, and the support of the senators of the Department of Civil Cases was confirmed. V. Jonikāns has worked in the field of civil law for long time, but for the last four years, since establishment of the Department of Administrative Cases, he led its work and majored in administrative matters. The Chief Justice of the Supreme Court said that such a good specialist and a good organizer who could change the organization of the Department’s work and - to a certain extent – reasoning, is at this moment necessary in the position of the Chairman of the Department of Civil Cases.

    The Plenary Session forms the work group for evaluation of ethics of judges

    After hearing the information by the General Prosecutor Jānis Maizītis and extensive debates, with majority of votes the Plenary Session of the Supreme Court formed a work group which will work parallel to the General Prosecutor’s Office and evaluate ethics of actions of those judges of the Supreme Court who, possibly, are involved in the telephone tapping scandal which indicated the connection of the judges with the attorney-at-law Andris Grūtups. Although the goals of the work group have not been set clearly yet, in the press conference after the Plenary Session the Chief Justice of the Supreme Court Andris Guļāns acknowledged that the fact that the work group as such was formed is already a result because there is no unanimity among the judges regarding the status of decoding of the published telephone calls and the necessity of its evaluation what was proved also by long debates in the Plenary Session.

    Press conference will take place after the Plenary Session of the Supreme Court

    Today, September 17, at 15.00, the Plenary Session of the Supreme Court will be held the agenda of which includes two issues. First, the Plenary Session will decide on appointment of the Senator of the Department of the Civil Cases of the Supreme Court Senate, and also the election of the Chairman of the Department. The vacancy in the Department of Civil Cases of the Senate opened after the death of Mārtiņš Dudelis on June 28, 2007, who held this position for long term.

    Augstākās tiesas Krimināllietu tiesu palāta 13. septembrī atlika krimināllietas izskatīšanu, kurā par krāpšanu lielos apmēros apsūdzēti Dmitrijs Fjodorovs, Aleksejs Anufrijevs, Arvīds Pupainis, Nikolajs Jurčenko, Raina Čača, Juris Bakāns, Aldis Iekļavs, Ēriks Aņisimovičs un Viktors Gornaks. Uz tiesas sēdi nebija ieradušies apsūdzētie A. Pupainis un A. Anufrijevs. Ē. Aņisimovičs atrodas slimnīcā un ārstniecības iestādes izraksts liecina, ka pacients tiks izrakstīts 14. 09. Tiesa apmierināja prokurora lūgumu un nolēma uz nākamo tiesas sēdi 17. 09. Pupaini un Anufrijevu nogādāt piespiedu kārtā.
