On March 31, the Chamber of Civil Cases of the Supreme Court has rejected the claim of Tatjana Prokofjeva to “Avon Cosmetics” Ltd. about compensation of moral harm in amount of LVL 160 000. The court of appeal has reviewed the case in court hearing on March 17. The full text of the decision of the court of appeal will be available after April 15, and since that date participants of the case will be able to appeal against it in cassation proceedings in the Senate of the Supreme Court.

On March 24, the Department of Civil Cases of the Senate reviewed in court hearing cassation claim of Kristine Dupate for the decision of the Judicial Panel of Civil Cases of Riga region court of December 11, 2008. By this decision the claim towards “Zurnals SANTA” Ltd., editor-in-chief of the magazine ”Privata dzive” Sandija Miezite and journalist Zane Karklina, about obligation to publish an excuse for excessive invasion in the private life of the claimant and recovery of moral harm in amount of LVL 5000. The Senate will announce the decision on April 7, at 9.25 a.m.

On March 24, the Department of Criminal Cases of the Senate of the Supreme court, having reviewed in written proceedings the protest, submitted by the prosecutor of Riga court district, about the decision of the court of Zemgales district of Riga city of January 26, 2010, by which agreement has been confirmed between prosecutor, accused parties and their advocates in criminal case about demand of the bribe and mediation in bribery, decided to review the case in oral proceedings in court hearing. The Senate made this decision on the ground of Paragraph 583 and 585 of Criminal Procedure Law that establishes the review of the case in court hearing if there is necessity for explanations from persons that have rights to participate in proceedings, and if the case may have special meaning in interpretation of law standard. The date of the court hearing has not yet been set.

Today the Chamber of Civil Cases of the Supreme Court has announced shorten sentence in the case about the claim of Anita Bertelsone and Raivis Kancuks against the Republic of Latvia in the person of the Ministry of Interior of the Republic of Latvia and National Fire and Life-Saving Service about moral harm caused in relation to tragic accident in Talsi on June 28. 1997, when in the fest organised by MI a basket of the lift fell down and nine children died. Among them were also daughter of A. Bertelsone and sister of R. Kancuks. The court of appeal has recovered Ls 20 000 to A. Bertelsone from NFLSS. In the rest part the claim of A. Bertelsone has been rejected. The claim of R. Kancuks has been rejected in total. Full decision of the court of appeal will be available after March 30, and after this date participants of the case will be able in 30 days to appeal against it in the Senate of the Supreme Court.

The Chamber of Civil Cases today reviewed the case about the claim of Martins Bite against the Republic of Latvia in person of the Ministry of Interior of the Republic of Latvia and National Fire and Life-Saving Service (NFLSS) about recovery of compensation for mutilation, disfigurement and harm caused to health in relation to tragic accident in Talsi on June 28, 1997. The court of appeal will announce the shorten sentence on March 25 at 9.50 a.m.

On March 9, the Department of Criminal Cases of the Senate of the Supreme Court in written proceedings has reviewed the cassation protest of General Prosecutor’s Office and cancelled the sentence of Riga Regional Court of October 30, 2009, by which the ex-state secretary of the Ministry of Education and Science (MES) Valdis Egle and ex-head of the Legal Department of the Administrative Department of MES Helena Kanepe considered to be guiltless and have been justified in accusation charged. The Senate sent the case for a new review in the court of appellate instance. The decision of the Senate is not reversible.
