Adviser to the Council for the Judiciary takes part in the experience exchange program in Brussels

In October, Dace Sulmane, Adviser to the Secretariat of the Council for the Judiciary, participated in the short-term exchange program organized by the European Network of Councils for the Judiciary (ENCJ) in Brussels. The purpose of the program is to promote the capacity and understanding of the employees of the Councils for the Judiciary of Member States on the formation and organization of work agenda of the ENCJ, as well as the work of the institutions in Brussels.

The Constitutional Court recognizes the system of judges' remuneration inconsistent with the Constitution

Today, on October 26, by the judgment of the Constitutional Court, in the case on the system of judges' remuneration, which was initiated following the application of the Council for the Judiciary, it is established that the provisions, stipulating that judge’s monthly salary is determined by linking it to salary of highly qualified lawyer of direct public administration institution with an appropriate wage rate, are not in conformity with the Sections 83 and 107 of the Constitution.

The Council for the Judiciary critically evaluates request for judicial budget 2018

The Council for the Judiciary acknowledges that the request for judicial budget for 2018 approved by the Cabinet of Ministers in the part of the remuneration does not correspond to the reform of the salaries of judges started in 2017. The Council for the Judiciary considers it unacceptable that the Ministry of Finance, contrary to the priorities submitted by the Ministry of Justice and supported by the Council for the Judiciary, has changed the budget request of both the Ministry of Justice and the Supreme Court.

The Council for the Judiciary evaluates the criteria for applying for judge's position in a higher instance court

The Council for the Judiciary believes that the requirements for judge's professional experience regarding application for a position of a judge at the higher instance court shall not be reduced, and the work experience criterion defined in the Law "On Judicial Power" should be preserved. That is, when applying for a position of a judge of a regional court a total length of service as a judge must be 6 years, for a position of a judge of the Supreme Court – 10 years.

Issues related to career of judges

The Council for the Judiciary appointed judge Linda Dizenberga to serve as a judge at Riga City Northern District Court, and judge Silvija Saleniece – at Rezekne Court. Linda Dizenberga and Silvija Saleniece were appointed as judges of district (city) court with a decision of the Saeima (parliament) of 21 September.

Agenda of the sitting of the Council for the Judiciary – amendments to the Law

On Monday, October 16, the Council for the Judiciary at the request of the Legal Affairs Committee of the Saeima (parliament) will continue to review the planned amendments to the Law "On Judicial Power", evaluating proposals that have been discussed and have not been agreed upon at the Legal Affairs Committee’s meeting before the third reading. These are issues regarding the length of office of a judge required for position of a judge of a regional court and for a position of a judge of the Supreme Court, as well as regarding the term for which a judge has the right to hold other positions.

Due to the fact that Aigars Sniedzitis, former judge of Bauska District Court, representative of district (city) courts at the Council for the Judiciary, has become a judge of Zemgale Regional Court, a member of the Council for the Judiciary from among the judges of district (city) courts should be re-elected during the Judges’ Conference.
