At the Plenary Session of the Supreme Court to be held on 4 September, judges will re-elect three members of the Disciplinary Court and the Chair of the Disciplinary Court. 

Five years have passed, since, in accordance with the law “On Judicial Power” and the Law on Disciplinary Liability of Judges, the Disciplinary Court was established within the Supreme Court and first six members of the Disciplinary Court were elected for five-year term.

Due to different reasons, some members of the Disciplinary Court have changed, so the term of office of those members, who were elected later, continues However, three of first judges have worked for five years in the Disciplinary Court, and their term of office expires on 30 September. They are Marite Zagere from the Department of Civil Cases, Anita Nusberga from the Department of Criminal Cases, and Andris Gulans from the Department of Administrative Cases. Marite Zagere has also been the Chair of the Disciplinary Court.  

Therefore, the Plenary Session of the Supreme Court will have to elect one member of the Disciplinary Court from each department. The Chair of the Disciplinary Court is elected from among members of the Disciplinary Court.

Section 21 of the Law on Disciplinary Liability of Judges stipulates that the Disciplinary Court is composed of six judges of the Supreme Court (two judges from the Department of Civil Cases, the Department of Criminal Cases and the Department of Administrative Cases), who are elected by the Plenary Session of the Supreme Court for five years. The member of the Disciplinary Court may not be simultaneously the member of the Council for the Judiciary, the Judicial Disciplinary Committee, the Judicial Qualification Committee, or the Judicial Ethics’ Committee.

The Disciplinary Court has been convened in the Supreme Court to examine appealed decisions adopted by the Judicial Disciplinary Committee, and to verify lawfulness of negative statements provided by the Judicial Qualification Committee, and to review appealed decisions of the Prosecutor General regarding imposition of disciplinary punishments.  

The Plenary Session of the Supreme Court will be held on Friday, 4 September, in Room 146 of the Supreme Court. The beginning is at 9.30 o’clock.
