Legal Commission accepts promotion of Torgans and Vidusa to the position of a judge of the Supreme Court

On February 7, the Legal Commission of the Saeima (Parliament) accepted the promotion of two nominees – Kalvis Torgans and Rudite Vernusa - to the position of a judge of the Supreme Court.
Professor of the University of Latvia, Department of Civil Law, habilitated Dr. jur. Kalvis Torgans is one of the most distinguished Latvian scientists in the field of civil law and civil procedure law.
K. Torgans works in the University of Latvia since 1962, he has held the position of the Dean of the Faculty of Law, Chief of the Department of Civil Law. He is the Chairman of the Board of the Faculty of Law of the University of Latvia, a member of the Promotion Commission in Law of the University of Latvia, and the Chairman of the Council of Professors in Law of the University of Latvia. Since 1997, K. Torgans is a full member of the Latvian Academy of Sciences and one of the three lawyers who have been elected academicians of the Latvian Academy of Sciences.
K. Torgans is the author of 178 scientific publications and books, among them the textbooks “Liability Law, Parts I and II”. He is the co-author and scientific editor of the bulky commentaries to the Civil Law and the Civil Procedure Law. The researches and publications of K. Torgans deal with the fields of civil law, entrepreneurial law, comparative jurisprudence, protection of the consumers’ rights. His publications are closely connected with the court practice what was furthered by his activities in the Latvian Bar, as well.
K. Torgans has led fulfillment of several grants and programs, at the present moment he heads the implementation of the program on application and development of the Latvian private law within the framework of the European Union. The professor has worked out and lectures the academic course “Civil Law” (Liability Law), the master’s programs “Legal problems of the agreements and offences” and “Methodology of the studies of civil law”. K. Torgans has a good knowledge in issues of application of private law within the framework of the European Union, he has delivered lectures in international conferences.
A recommendation for promotion of K. Torgans to the position of a judge of the Supreme Court was given by the Chief of the Department of Civil Law of the Faculty of Law of the University of Latvia, Professor Dr. jur. Janis Rozenfelds. He notes that K. Torgans has gained respect in a wide circle of lawyers as a principled, honest and just person, and regardless of the problems which could be caused to the Faculty of Law by decrease or termination of his educational activities, he recommends K. Torgans to the work in the Supreme Court. Positive reference was given also by the Chairman of the Department of Civil Cases of the Supreme Court Valerijans Jonikans, and a positive opinion regarding confirmation of K. Torgans in the position of a judge of the Supreme Court was expressed also by the Judicial Qualification Panel.
A recommendation for confirmation of Rudite Vidusa in the position of a judge of the Supreme Court was given by the senator of the Department of Administrative Cases of the Senate, Associate Professor of the University of Latvia, Dr. jur. Jautrite Briede, and the founder and chief editor of the magazine “Law and Rights”, Habil. Dr. jur. Edgars Melkisis. A positive opinion regarding confirmation of R. Vidusa in the position of a judge of the Supreme Court was expressed also by the Judicial Qualification Panel.
Senator Briede knew R. Vidusa as a good student, especially in the Center of Judicial practice and assistance, later – as a colleague in the University of Latvia where R. Vidusa worked in the editorial board of the magazine “Law and Rights”. In 2004, when J. Briede became a judge of the Supreme Court, she invited R. Vidusa to become her assistant, and she showed herself as a good lawyer who is able both to delve in details and see the problem and its settlement in general.
In 2005, R. Vidusa became a judge of the Administrative District Court, and already in the same year she was asked to become a judge of the Administrative Regional Court. But starting from February 2007 she was asked to substitute the senator G. Visnakova of the Department of Administrative Cases of the Supreme Court Senate during her illness. In the Department of Administrative Cases, R. Vidusa proved to be a knowing judge, several of the rulings adopted by her have been a contribution not only to the development of the court practice, but also to the jurisprudence.
R. Vidusa has graduated from the University of Latvia, Faculty of Law, she perfects her knowledge by regular participation in the training and thematic seminars for administrative judges in the Latvian Judicial Training Center, seminars of the European Association of Administrative Judges, and trainings organized by the European Institute of Public Administration and the European Commission. She herself gives lectures for judges and notaries in the Latvian Judicial Training Center and the annual seminars of the policy of public law of the Institute of Public Law and the Dischler association. In 2007 – 2008, R. Vidusa participates in preparation of commentaries to the Administrative procedure law.
The Legal Commission will prepare a draft decision for the Saeima regarding confirmation of K. Torgans and R. Vidusa in the position of a judge of the Supreme Court. After a positive voting of the Saeima, the judges will be appointed to a specific structural unit of the Court by a decision of the Plenary Session of the Supreme Court.
