The right of the insured whose civil liability is insured in a travel insurance contract to demand payment of insurance benefit; Identifying the applicable law if the insured person requests from the civil liability insurer to recover insurance benefit due to losses, the claim for compensation of which on the basis of the law, by exercising subrogation right has been taken over from the victim by a person domiciled in another Member State of the European Union; Comparison of compensation for moral damage with the compensation for pain and suffering known in the European legal area; Assessing the unfair character of limitation of liability set in a travel insurance contract concluded with a consumer, which provides for non-compensation of moral damage within the framework of civil liability insurance
