The University of Latvia Press has published a research work carried out by Ph.D. Oskars Kulmanis, a lecturer at the Faculty of Law of the University of Latvia and legal research counsel to the Senate's Department of Criminal Cases, entitled "Pierādījumu pieļaujamības tiesiskie un praktiskie aspekti” (Legal and Practical Aspects of the Admissibility of Evidence).
The research provides an in-depth look at one of the central institutions of criminal procedure – the admissibility of evidence. The author analyzes the connection between the acquisition, consolidation, and examination of evidence and the fundamental principles of criminal proceedings and the ensuring of a fair trial, based on national and European case law.
The author examines how procedural guarantees, respect for human rights and the proof theory affect the validity of the final decision, and offers practical solutions for the evaluation of evidence.
