15. novembris, 2024.
Volume 4 of the Digest of European Tort Law: Essential Cases on the Limits of Liability has been published as part of a research project led by the Institute for European Tort Law of the Austrian Academy of Sciences and the University of Graz.
Within the research, the most important court cases in 27 European countries on limitation of liability in the events of breach of non-contractual or tort obligations have been selected and analysed. It also includes a report on the most important judgments of the Court of Justice of the European Union on limitation of civil liability.
The cases are structured into ten categories of how civil liability for committing a tort can be limited, for example, limiting liability in cases where consequences of an action cannot be foreseeable or when liability should be limited based on the protective purpose of a legal provision.
The report on the most significant Latvian court cases dealing with limitation of civil liability in tort cases was prepared for this European study by Dr. iur. Rihards Gulbis, a legal research counsel to the Senate’s Department of Civil Cases, and Dr. iur. Jānis Kubilis, a professor at the University of Latvia.
Volume 4 of the Digest of European Tort Law: Essential Cases on the Limits of Liability is a continuation of previous compilations, where Volume 1 was dedicated to issues of causation (2007), Volume 2 – to types of damage (2011), Volume 3 – to understanding tortious acts (2018). The reports on Latvian cases in these volumes were prepared by Professor Kalvis Torgāns, who chose Rihards Gulbis and Jānis Kubilis as the continuers of his work in this project.
